Event Agreement


This Event Agreement is made by and between Lisa and Bryan Babcock (hereinafter referred to as “the Owners”) and you, (herein referred to as the “the Renting Party”) for the use of some or all (see below) of the premises of the Babcock Vintner’s Home & Cottage, 1859 San Leandro Lane, Montecito, CA 93108 (herein referred to as “the Property”), for the purposes of a social gathering of 13 or more persons.

1. The Renting Party agrees to pay an Event Fee, the amount of which will be confirmed by the renting party via email prior to the execution of this Event Agreement. In addition to this Event Agreement and Fee, the Renting Party is also required to contract with the Owners for the Babcock Vintner’s Home and Cottage (herein referred to as “the Home”) as a vacation rental. A separate Vacation Rental Agreement and Fees (herein known as “the Home Agreement”) will apply for the Home.

2. Smaller Events with fewer than thirty-five (35) guests may use the entire premises including the Home, Guest Cottage and outside lawn areas. Larger Events may not use the Home and all Event activities must be held in the outdoor areas of the property (herein known as “the Grounds”). The number of guests attending an Event is defined as the total number of guests including guests listed on the Home Agreement (herein referred to as “Occupant-Guests”) and guests not listed on the Home Agreement (herein referred to as “Non-Occupant Guests”).

3. To secure a reservation for an Event, a deposit of one half (1/2) of the Event Fee is due upon the execution of this Event Agreement. If there is a cancellation prior to forty-five (45) days before your Event, there will be a Transaction Fee of 10% of this deposit. The second half (1/2) of the Event Fee and a $1,000 Event Security Deposit are due forty-five (45) days prior to the Event. This security deposit will be refunded within seven (7) days of your departure if the property is left in its original condition. In the case of cancellations less than forty-five (45) days prior to the Event, an additional Transaction Fee of 10% of the first deposit will be applied. Any deposits made toward the Renting Party’s Home Agreement are nonrefundable in the case of no shows or cancellations less than 45 days prior to the Event. 4. Payments can be made by cash, check or credit card. Checks should be made payable to Lisa and Bryan Babcock. We accept Master Card, Visa and American Express. Applicable credit card processing fees will apply.

5. The Renting Party will provide a Commercial and General Liability Certificate of Insurance that will cover the Property at 1859 San Leandro Lane, Montecito, CA 93108 for the date of the Event in the amount of $1,000,000, and will name Lisa and Bryan Babcock as additional insured. Certificates of Insurance must not have any alcohol exclusions. Owners must be in receipt of this document no later than forty-five days (45) prior to the Event. For your information, Event insurance can be purchased from Renting Party’s existing home owner’s policy or from www.WedSafe.com.

6. The Renting Party hereby agrees to release and indemnify the Owners and/or their agents from and against any and all liability, should anyone be injured during the Event, resulting from any cause whatsoever. The Renting Party is responsible for the conduct of all persons attending and assisting the Event. Renting Party shall be liable for all damage or loss to the Property caused by the Event or persons attending or assisting the Event.

7. The Renting Party is responsible for all set-up and clean-up of the Property including bagging all trash and debris, and placing the trash and recyclables into their designated receptacles. All outside equipment or decorations must be removed from Property by 11:00 AM on the day the Home Agreement ends. Renting Party shall be liable for clean-up and repairs of the property including the reasonable costs of such cleaning and repairs as determined by the Owners. Use of the Property requires that it be returned in its original condition.

8. The following times are designated for site access and departure:

Renting Party and their hired vendors are allowed to enter anytime after 4:00 PM on the day the Home Agreement begins and must vacate the Property by 11:00 AM on the day the Home Agreement ends.

In addition to the Event, Renting Party may use the Home for an intimate gathering such as a rehearsal dinner or post wedding brunch with no more than thirty-five (35) Guests. Larger groups will require a separate Event Agreement to be signed and additional Events Fees will apply.

9. A minimum of one Property Supervisor (herein known as “the Supervisor”) will assist at any Event with more than thirty-five (35) guests. This Supervisor will be arranged by the Owners and will act as a representative of the Owners. The Supervisor will be present from the start of the Event until its conclusion, or until the Supervisor determines that the Event has sufficiently wound down to a point when his/her services are no longer required. The rate for the Supervisor is $25.00 per hour with a minimum of three hours. Estimated fees for the Supervisor are due forty-five (45) days prior to the Event. The Supervisor’s services do not include wedding coordination, equipment set-up or equipment break-down. We recommend that you hire a professional wedding coordinator to work with your hired vendors.

10. The following vendors are required for all Events with more than thirty-five (35) Guests and must be chosen by the Renting Party from the list of approved companies provided in the Babcock Vintner’s Home Event Vendors List (herein referred to as “the Vendors List”).

Renting Party must hire a caterer. The caterer must supply all staff for food service, bar service, set up of equipment, break down of equipment, clean up of kitchen and grounds, etc. The caterer must set up a satellite kitchen in the driveway located adjacent to the Cottage.

Renting Party must hire security. Security staff must be present from the start to the conclusion of the Event.

Renting Party must rent portable restrooms. House restrooms may only be used by Occupant-Guests and the bridal party. One portable his & hers restroom will be required per every 75 Guests. For example, an Event with 90 Guests will require two portable his & hers restrooms.

The Renting Party must hire valet and/or shuttle services. For Events with less than 35 guests, this clause of this Event Agreement is commensurate with the Home Agreement; that is, there may be a maximum of six (6) vehicles parked on the Property (including vendor and/or guests vehicles) at any one time. For Events with more than 35 guests, the maximum number of vehicles permitted in the front driveway of the Home is four (4), with the rear driveway of the property being reserved for the caterers, their satellite kitchen and/or their vehicles. Valet/shuttle service vendors must be chosen from the Vendor List. Event parking is not permitted on San Leandro Lane.

11. Copies of all signed contracts and a vendor list including contact information, phone, email, delivery and strike times of all vendors assisting the Event must be submitted by fax or email to Owners no later than forty-five (45) days prior to the Event. Failure to deliver such information may constitute grounds for cancellation of the Event with the 10% Transaction Fee applicable (see clause #4 of this Event Agreement).

12. The Renting Party must let all guests know that the Event ends at 10:00 PM. A one hour grace period will then ensue so that all Non-Occupant guests can gracefully depart. Caterers and/or hired vendors will also have this hour to clean up for the evening. The Supervisor and/or the Event security will check with the Renting Party at 11:00 PM to confirm that all Non-Occupant Guests have vacated and to make sure that all remaining vendors are wrapping things up.

13. Amplified music is permitted during the Event but can not be played louder than 90 decibels. All music must conclude, per local Santa Barbara noise ordinances, by 10:00 PM. Owners reserve the right to terminate the Event via law enforcement if this policy is ignored.

14. Renting party is allowed to serve a full bar during the Event to include distilled spirits, beer and wine. Renting Party must provide an unlimited amount of non-alcoholic beverages throughout the Event. The Owners reserve the right to terminate the Event via law enforcement if this policy is ignored. For your convenience, wine may be purchased by the case from Babcock Winery at a discounted rate. Please request a copy of our current wine list and prices. Wine orders may be placed fifteen (15) days prior to the Event and will be delivered to the Property before or in close proximity to the Rental Party’s arrival.

15. No alcohol will be served by the Renting Party, their Guests, or any of their vendors after 9:30 PM.

16. A dance floor may be placed on the grass on the day of Event and must be removed within 24 hours. A tent may be placed on the grass on the day prior to Event and must be removed within 48 hours

17. Candles are permitted on the Property, but MUST be in enclosed containers and can not be placed on the ground. The Owners/Supervisor reserves the right to move, extinguish, or remove any candles that they deem to be unsafe.

18. Pets are not permitted on the Property during Events.

19. No confetti, glitter, other non-organic decorations, rice or bird seed are permitted at the Property. Nails, staples and other permanent fastening material are prohibited. All tape, zip-ties, wire or other approved non-permanent fastening material must be removed after the Event. Please use the utmost care when hanging lanterns or other items from any buildings or trees.

20. If the Renting Party or anyone attending or assisting the Event violates any of the terms of this agreement, the Owners may, at the Owner’s sole discretion, terminate this Event with no refund.

21. The Owners have the right to enter the premise with cause with 24 hour notice. In emergency situations, the Owners may enter at any time.

22. All Events are to be held for responsible adults only. No high school, college or civic groups, chaperoned or not, are permitted. Violation is grounds for immediate Event termination with no refund. Renting Party agrees that the Property shall not be used for any illegal or unlawful purposes. Use of the Property and common areas in such a fashion that disturbs or offends local residents, such as excess noise, shall be deemed grounds for Event termination via local law enforcement. Renting Party must respect the fact that the Property is located in a residential neighborhood.

23. Owners shall not be held liable for any impact due to weather or other natural causes on the quality or feasibility of the Event. In the event of inclement weather or other impacting circumstances, it is the sole responsibility of the Renting Party to acquire necessary Event equipment including tents and canopies.

24. In the event that the Owners are unable to deliver said Property to Renting Party under this Event agreement because of fire, eminent domain, act of nature, delay in construction or any other unforeseen reason whatsoever, Renting Party hereby agrees that Owners’ sole liability as a result of these conditions is a full refund of all monies previously tendered by Renting Party. Pursuant to the terms of this agreement, Renting Party expressly acknowledges that in no event shall the Owners be held liable for any consequential or secondary damages, including but not limited to, any expenses incurred as a result of moving Event because of any damage, destruction or loss.
